In a case where the Plaintiff alleged general negligence in supervision and oversight that resulted in traumatic injuries, Glassman, Wyatt, Tuttle & Cox, P.C. attorney Kyle Cannon swiftly and efficiently secured summary judgment on behalf of a local business. The Plaintiff, while under the care and supervision of an employee of the firm’s client, operated an all-terrain vehicle and was involved in an accident that caused significant injuries.
Armed with expertise in commercial litigation and after initial pleadings and preliminary discovery had taken place, Memphis trial attorney Kyle Cannon filed a motion for Summary Judgment alleging that the lawsuit was incorrectly filed and incorrectly pled, that the Plaintiff had failed to satisfy the statutory prerequisites for filing the correct cause of action and, consequently, the Plaintiff’s lawsuit should be dismissed. In addition, the Motion concluded that the statute of limitations had expired on the Plaintiff’s ability to amend pleadings and/or satisfy the statutory prerequisites for filing a cause of action against the firm’s client. The trial court agreed with Cannon’s motion and dismissed the Plaintiff’s lawsuit, with prejudice.
