In the matter at hand, the defendant client in a malicious prosecution action moved to dismiss for failure to state a claim upon which relief can be granted. The firm argued that the underlying action was not terminated on its merits, so dismissal of the malicious prosecution action was warranted. The trial court in Davidson County (Nashville) agreed with the Firm – and so did the Tennessee Court of Appeals. The Firm also was awarded $10,000.00 in attorney’s fees via the granting of the motion to dismiss.
