Glassman, Wyatt, Tuttle & Cox, PC attorneys Robert Cox and Ed Wallis secured dismissal of a case that sought $17.5 million against their clients via allegations of defective construction and traffic control. Realizing that the case would likely hinge on the Arkansas doctrine of acquired immunity, Robert and Ed set out at the onset of the case to craft a defense plan to focus on facts and law needed to achieve summary judgment.
Not letting go of these initial goals, Robert and Ed left no stone unturned for their client during the defense of the case. By the time summary judgment motions were filed with the Court, the Firm had secured key concessions from fact and expert witnesses that the Firm’s client had not violated any industry standards. Indeed, the Firm filed and the Court granted a motion to strike one of the key experts of the opposing party against the Firm’s client – in full – because of unreliable opinions and speculative testimony, including by way of examination under the Manual on Uniform Traffic Control Devices.
Robert and Ed both strengthened their already well versed foundation in temporary tranffic control on roadways to examine witnesses in traffic control, construction, engineering, expert and state administration fields. The case is a prime example of the attention to detail by the Firm’s attorneys.
The Court eventually dismissed the case against the Firm’s client using briefs prepared by and argued by Robert and Ed. The case is a key example of the Firm’s ability to set a goal at the onset, use complex and copious amounts of written discovery, document production and depositions (of both fact and expert witnesses) and secure dismissal.
